Flairée Privacy Policy

Jakel Epiphanies LLC DBA Flairée ("Flairée," "we," "us," or "our") respects your privacy and values the relationship we have with you. This Privacy Policy explains the personal information we collect, how and why we use it, how we disclose it, how we protect it, and the rights and choices that may be available to you.

This Privacy Policy applies to personal information collected through flairee.co, any other website, online store, application, feature, or service that links to this Privacy Policy (collectively, the "Services"), and our related communications with you. Unless we tell you otherwise when you provide your information, personal information collected independently by third-party retail locations is governed by those retailers' own privacy practices and is not covered by this Privacy Policy.

Personal Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information:

  • Contact information and identifiers, such as your name, billing and shipping addresses, email address, telephone number, account information, and customer or order identifiers.
  • SMS program information, such as your mobile telephone number, SMS subscription status, the date, time, and source of your consent, message history, and opt-out records.
  • Order and commercial information, such as products viewed, products added to a cart, purchases, returns, exchanges, discounts, reviews, and other transaction history.
  • Payment information, such as payment-card and billing details. Payment information is generally collected and processed by Shopify and our payment processors; we do not directly store complete payment-card numbers.
  • Device, internet, and network activity information, such as your IP address, browser type, device type, operating system, cookie or advertising identifiers, pages viewed, links clicked, referring URLs, search activity, interactions with our Services, and cart or checkout activity.
  • Approximate location information, such as the country, state, or city inferred from your IP address. We do not collect precise GPS location through the Services.
  • Preferences and profile information, such as fragrance preferences, survey or quiz responses, marketing preferences, and inferences about products or offers that may interest you.
  • Demographic information, such as age range or other demographic information you choose to provide.
  • Physical or health-related information you voluntarily provide, such as allergies, sensitivities, or other information relevant to a product question or request. We do not use this information to diagnose or treat any medical condition.
  • User content and communications, such as product reviews, photos, social media content, survey responses, contest entries, customer-support messages, and other content you submit.
  • Fraud-prevention and security information, such as information used to verify transactions, protect accounts, and detect suspicious or unlawful activity.

We may create aggregated or de-identified information that cannot reasonably be used to identify you. We may use and disclose that information for any lawful purpose and will not attempt to re-identify it except as permitted by law.

How We Collect Personal Information

We collect personal information from the following sources:

  • Directly from you, including when you place an order, create or use an account, contact us, submit a form or quiz, write a review, enter a promotion, or subscribe to email or text marketing.
  • Automatically through the Services, including through cookies, pixels, tags, software development kits, Shopify features, plugins, and similar technologies.
  • From service providers and business partners, such as Shopify, payment processors, shipping and fulfillment providers, analytics providers, advertising partners, social media platforms, and providers that help us operate our email and SMS programs.
  • From social media platforms and networks when you interact with our pages, advertisements, or content, subject to the platform's settings and privacy practices.

How We Use Personal Information

We may use personal information to:

  • Provide, personalize, and improve the Services and our products;
  • Process and fulfill orders, payments, returns, exchanges, and refunds;
  • Communicate with you about orders, accounts, customer service, security, policy updates, and other service-related matters;
  • Send marketing and promotional communications when permitted by law and consistent with your choices;
  • Operate our SMS program, including sending promotional messages and abandoned-cart or abandoned-checkout reminders to subscribers;
  • Maintain accounts, remember preferences, and provide product recommendations;
  • Administer surveys, quizzes, reviews, events, contests, and promotions;
  • Measure and understand how people use our Services, improve site performance, and develop products and features;
  • Provide, measure, and improve advertising, including interest-based advertising where permitted;

  • Comply with legal obligations, enforce our agreements, and establish, exercise, or defend legal claims; and

SMS Marketing and Abandoned-Cart Messages

How We Collect and Use Mobile Information

We collect your mobile telephone number when you voluntarily provide it through an SMS sign-up form, at checkout, through an account or subscription tool, or in another interaction with us. If you provide a telephone number only for shipping, delivery, order support, or another non-marketing purpose, we will not use that number for SMS marketing unless you separately consent to receive marketing text messages.

If you opt in to Flairée's SMS program, we may use your mobile number and related consent records to send recurring promotional offers, product news, transactional or service-related communications, and abandoned-cart or abandoned-checkout reminders, as described at the point of sign-up. Consent to receive marketing text messages is not a condition of purchase.

How We Identify an Abandoned Cart

Flairée's website uses cookies, Shopify features, plugins, and similar technologies to keep track of products you view or place in your shopping cart, the status of your cart or checkout, and whether a purchase is completed. When you are an SMS subscriber, this information may be associated with your subscription and used to determine whether and when to send you a cart or checkout reminder by text message.

How We Store and Disclose Mobile Information

Mobile numbers, consent records, and related messaging information may be stored by Flairée, Shopify, and the SMS platform providers that process this information on our behalf. We use these records to operate the SMS program, document consent, honor opt-out requests, prevent misuse, and comply with law.

We do not sell or rent mobile information or disclose it to third parties or affiliates for their own marketing or promotional purposes. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We may provide mobile information to SMS platform providers, telecommunications carriers, and other vendors that act solely on our behalf and need the information to deliver messages, maintain consent and suppression records, provide customer support, prevent fraud or abuse, and otherwise operate the SMS program. These providers may use the information only to perform services for us or as required by law. For purposes of this SMS disclosure, vendors that process mobile information solely on our behalf are service providers and are not third parties that receive the information for their own purposes.

Your SMS Choices

You may withdraw your consent and opt out of marketing text messages at any time by replying STOP to a message from us. You may also use any other reasonable method that clearly communicates your request, including emailing hello@flairee.co. We may send one non-promotional message confirming your opt-out. For help, reply HELP or email us. Message frequency varies, and message and data rates may apply.

Cookies, Analytics, Advertising, and Location Information

Cookies and Similar Technologies

We and our service providers use cookies, pixels, tags, plugins, and similar technologies to operate the Services, remember your choices, keep track of your cart, understand site usage, protect the Services, and support analytics and advertising. Some cookies are necessary for the Services to function, while others support preferences, analytics, or advertising. You can manage cookies through available site controls and your browser settings. Blocking certain cookies may affect how the Services function.

Analytics and Interest-Based Advertising

We use analytics services, including Google Analytics, to understand use of the Services. Advertising partners may use cookies and similar technologies to collect information about your interactions with our Services and other websites in order to provide or measure advertisements that may be relevant to your interests. These industry tools are separate from any privacy rights request described below.

Location Information

We do not use the Services to collect precise GPS location or provide precise location-based services. We and our service providers may infer a general location, such as your country, state, or city, from your IP address. We use approximate location to display relevant site content, language, currency, products, shipping options, or advertisements; perform analytics; prevent fraud; and protect the Services. If we begin collecting precise location information in the future, we will provide any required notice and obtain any required consent before doing so.

How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this Privacy Policy:

  • Commerce and technology providers, including Shopify, website hosting, cloud storage, account, security, and other technology providers that help operate the Services.
  • Payment, order, and delivery providers, including payment processors, fraud-prevention providers, fulfillment partners, carriers, and return processors.
  • Marketing and communications providers, including email and SMS platform providers that send communications and maintain subscription records on our behalf.
  • Analytics and advertising partners that help us measure use of the Services, understand audiences, and provide or measure advertising, subject to your available privacy choices.
  • Professional advisers, such as accountants, auditors, insurers, lawyers, and other advisers who provide professional services to us.

As stated above, the categories of disclosure in this section do not include disclosure of text messaging originator opt-in data or consent to third parties or affiliates for their own marketing or promotional purposes.

Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, complete transactions, maintain business and consent records, honor marketing suppression requests, prevent fraud, resolve disputes, enforce agreements, and comply with legal, tax, accounting, or reporting obligations. The retention period depends on the type of information, why we collected it, and applicable legal requirements. When information is no longer needed, we may delete, destroy, or de-identify it.

Your Rights and Choices

Depending on where you live, you may have the right to request access to or a copy of your personal information; request correction or deletion; request information about our collection, use, or disclosure of your information; opt out of certain targeted advertising, sales, or sharing; limit certain uses of sensitive personal information; withdraw consent; or appeal a decision concerning a privacy request. These rights may be subject to exceptions and limitations under applicable law.

We will not discriminate against you for exercising an applicable privacy right.

Email Marketing

You may opt out of marketing emails by using the unsubscribe link in any marketing email or by contacting hello@flairee.co. Even if you opt out of marketing, we may continue to send non-promotional communications about your orders, account, or our ongoing business relationship.

Text Message Marketing

You may opt out of marketing text messages as described in the "Your SMS Choices" section above.

Targeted Advertising and Cookie Choices

You can manage certain cookie choices through available site controls or your browser. Depending on where you live, you may also opt out of activity that may be considered a sale, sharing, or targeted advertising by visiting our Your Privacy Choices page. Where required by law, we also process opt-out preference signals, such as Global Privacy Control, for the browser and device that send the signal.

Additional Disclosures for California Residents

This section applies to California residents to the extent the California Consumer Privacy Act, as amended ("CCPA"), applies to Flairée. The categories of personal information we have collected, the sources from which we collect it, our business or commercial purposes, and the categories of recipients to which we disclose it are described in the sections above.

California Privacy Rights

Subject to applicable exceptions, California residents may have the right to:

  • Know the categories and specific pieces of personal information we have collected about them, the sources and purposes of collection, and the categories of recipients to which information was disclosed, sold, or shared;
  • Request deletion of personal information we collected from them;
  • Request correction of inaccurate personal information;
  • Opt out of the sale or sharing of personal information;
  • Limit certain uses or disclosures of sensitive personal information; and
  • Receive equal service and pricing without unlawful discrimination for exercising their rights.

Sale, Sharing, and Targeted Advertising

We do not sell personal information for money. However, our use of advertising cookies and similar technologies may be considered "selling" or "sharing" personal information under the CCPA, even when no money is exchanged. In the preceding 12 months, we may have shared identifiers, device and internet or network activity information, commercial information, approximate location, and related inferences with advertising and analytics partners for cross-context behavioral advertising. We do not knowingly sell or share the personal information of consumers under 16.

Mobile telephone numbers, text messaging originator opt-in data, and consent are not sold or shared for cross-context behavioral advertising or disclosed to third parties or affiliates for their own marketing or promotional purposes.

California residents may opt out by visiting Your Privacy Choices or by using a recognized opt-out preference signal such as Global Privacy Control. Because these choices may be browser- and device-specific, you may need to make your selection on each browser and device you use.

Sensitive Personal Information

We use sensitive personal information, if any, only to provide requested products or services, process transactions, protect the Services, comply with law, and for other purposes permitted by the CCPA. We do not use or disclose sensitive personal information to infer characteristics about you for advertising.

Submitting and Verifying a California Request

To submit a request to know, access, delete, or correct personal information, email hello@flairee.co. We may request information reasonably necessary to verify your identity and match you with our records. An authorized agent may submit a request on your behalf. We may require proof of the agent's authority and may ask you to verify your identity or confirm that you authorized the request. You do not need to create an account to submit a request.

International Data Transfers

We and our service providers may process personal information in the United States and other countries that may have data-protection laws different from those in your country of residence. Where required, we use appropriate safeguards for international transfers of personal information.

Children's Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can take appropriate action. We do not knowingly sell or share the personal information of consumers under 16.

How We Protect Personal Information

We use reasonable administrative, technical, and physical safeguards designed to protect personal information.
